SALE OF LAND RECEIVED FREE OF CHARGE

 Are there any restrictions on the disposal of a land plot received free of charge by the decision of the akimat for the construction of an individual residential building? Will I have to pay the full cost in this case?

If the rights to the site are issued and registered in accordance with the established procedure, then the site is in private ownership.

In accordance with Article 25 of the Land Code of the Republic of Kazakhstan, the owner of a land plot exercises the rights to own, use and dispose of a land plot at his own discretion without obtaining any permission from state bodies, unless otherwise provided by the Law. The owner has the right to make any transactions in relation to his land plot without changing its designated purpose, which are not prohibited by the legislative acts of the Republic of Kazakhstan.

For this case, the law does not provide for any restrictions on transactions. Therefore, the owner is free to sell the land.

However, according to Article 50 of the Land Code, the citizen who sold it will not be able to re-obtain a land plot for individual housing construction free of charge.
